23rd annual report from the Commission on monitoring the application of Community Law (2005)

The Commission Staff Working Document Annex to the 23rd annual report from
the Commission on monitoring the application of Community Law (2005)
on page 45 refers to the state of the art of the implementation of Directive 2003/4/EC in 2005.

The Directive had to be transposed into national law by 14 February 2005. The Commission
sent reasoned opinions to Austria, France, Hungary, Ireland and Portugal and decided to refer
Belgium, Greece, Spain and Luxembourg to the Court of Justice for failure to meet this
deadline.

The Public Participation Directive

European Directive 2003/35/EC (known as the Public Participation Directive or PPD) transposes the second and third pillar of the provisions of the UNECE Convention on Access to Information, Public Participation in Decision-making and Access to Justice in Environmental Matters (also known as the Aarhus Convention) into European Community law.
